General Terms and Conditions

Please note: For the purchase of online-tickets the following extended terms and conditions  additionally apply.

  

1. REGISTRATION AND CONCLUSION OF CONTRACT

With the written or oral registration the contracting partner (herein after called "customer") bindingly accepts the conclusion of a travel agreement. This registration applies to group tours for all members of the group and any outstanding claims. With the registration the customer accepts the general terms and conditions. 
 
The booking is binding as soon as the service is ordered and confirmed by Weis(s)er Stadtvogel München (herein after called "organiser") via fax, e-mail, in written or oral form.

2. PAYMENT

The payment of the service is made upon completion of the service by invoice or in cash without any deduction. Unless otherwise agreed or stated payment is in cash for amounts up to EUR 200. If the customer nevertheless wishes to pay by invoice an additional fee of EUR 10 becomes due.

 

3. PAYMENT BY INVOICE FOR AMOUNTS UP TO EUR 200

If the customer wishes to pay by invoice for amounts up to EUR 200, we charge an extra fee of EUR 10.

 

4. Laying out of forwarding expenses lump-sum of 10% 

If the customer wishes the payment of performances not previously laid down in writing, like the advancing of payments by us for entrance tickets or the payment of a second bill for drinks an additional fee of 10% of the extra amount becomes due.

5. SERVICES AND CHANGES TO SERVICE

The scope of the contractual services is given by the service description of the organiser. Supplements to the agreement require a written confirmation from the organiser. 
 
The discontinuation of individual service elements does not qualify for retention of the contractual sum or for partial withdrawal, as long as it involves reasons for which the organiser is not responsible. If the organiser is responsible for the reasons for the discontinuation of certain service elements, the right ensues to have these service elements replaced with others of equal value. The organiser is obliged to inform the customer of the above. Under certain circumstances the organiser will offer the customer a re-booking or a withdrawal (cancellation) free of charge. 

 

6. CUSTOMER WITHDRAWAL (CANCELLATION)

The customer can withdraw any time before the beginning of the reserved trip. The decisive factor for the cancellation of registration is at the time that this notice of resignation reaches the organiser. 
The withdrawal must take place in writing and must be confirmed by the organiser. If the customer withdraws from the contract or does not keep an arranged appointment without having withdrawn from the contract previously, the organiser can demand an appropriate compensation. The organiser can make a concrete calculation of the damages, or can validate a general cancellation charge. This amounts to 100% of the contractual sum total from 48 hours (2 days) prior to the event´s beginning and upon non-appearance by the customer.

 

7. WITHDRAWAL AND CANCELLATION BY WEIS(S)ER STADTVOGEL MÜNCHEN

In the following cases the organiser can withdraw from the contract:

- in the case of force majeure 
- in case of sudden illness of a guide
- if the customer or a participant of a group of the customer continuous to disturb or if he or she behaves to such a considerable degree against the terms of the contract that immediate cancellation is justified
- if the customer does not observe the agreed conditions of the contract

  

8. LIABILITY

Weis(s)er Stadtvogel München is liable as the organiser for conscientious preparation of the event, the careful choice and control of services, the correctness of the event description and the orderly performance of the services agreed to.

Weis(s)er Stadtvogel München shall not be liable for services that are arranged as services of other parties (e.g. tours of other operators, transport, visiting museums, theatres or exhibitions etc.) and others expressly stated to be third party services in the event description. Moreover we assume no liability for damages and accidents.

 

9. OBLIGATION TO CO-OPERATE

If problems with the performance of the services arise the customer or the participant of a group of the customer are obliged to co-operate within the framework of statutory regulations to avoid damage or minimise damage. The customer or the participant of a group of the customer are particularly obliged to inform Weis(s)er Stadtvogel München immediately about complaints.

 

10. DATA PROTECTION

The customer agrees that the organiser may continue using the data made available for carrying out the services agreed for customer support service in accordance with German data security law. This data will not be passed on to third parties.

11. NULLITY OF INDIVIDUAL TERMS

The nullity of individual conditions of the General Terms and conditions or of the contract does not result in the nullity of the entire contract.

 

12. PLACE OF FULFILMENT AND COURT OF VENUE

Place of fulfilment and exclusive place of jurisdiction is Munich.
